Quixyr Terms of Use
Effective Date: October 28, 2025
These Terms of Use (“Terms”) govern your access to and use of the Quixyr mobile application (“Quixyr” or the “App”) and related services (collectively, the “Services”), operated by Quixyr LLC (“Quixyr,” “we,” “us,” or “our”). By downloading, accessing, or using Quixyr, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.
1. Acceptance of Terms
Your use of Quixyr constitutes your acceptance of these Terms, which may be updated from time to time. We will notify you of material changes via email or in-app notice. Continued use after changes means you accept the updated Terms.
2. Eligibility
You must be at least 18 years old to use Quixyr globally, and 19 years old in South Korea, per the Act on Promotion of Information and Communications Network Utilization. You represent that you meet these age requirements and are legally capable of entering into binding contracts.
3. Account Responsibilities
- You are responsible for maintaining the confidentiality of your account credentials.
- You are fully responsible for all activities that occur under your account.
- You must immediately notify us at support@quixyr.com of any unauthorized use.
- We reserve the right to suspend or terminate accounts for any reason, including violation of these Terms.
4. User Conduct & Prohibited Activities
You agree not to:
- Engage in harassment, bullying, hate speech, or discrimination.
- Post or share illegal, harmful, explicit, or non-consensual content.
- Impersonate others or create fake profiles.
- Use bots, scripts, or automated tools to interact with the App.
- Interfere with the App’s functionality or security.
- Attempt to access others’ accounts or data.
- Violate any applicable law or regulation.
Nudity & Naked Images Strictly Prohibited: You may not upload, share, or display any images containing nudity, partial nudity, or sexually suggestive content. This includes any visible genitals, buttocks, or female nipples, even if covered by clothing, hands, or emojis. All profile and chat images are automatically moderated using AWS Rekognition to detect and remove such content. Violations result in immediate account suspension or termination.
Violations of any prohibited activity may result in immediate account termination and reporting to authorities.
5. Content Ownership & License
You retain ownership of content you upload (photos, messages, etc.). By using Quixyr, you grant us a worldwide, non-exclusive, royalty-free license to use, store, display, and distribute your content as necessary to operate and improve the Services.
6. Matching & Messaging
Quixyr uses your precise location (with consent) to match you with nearby users. We do not guarantee matches, conversations, or outcomes. All interactions are at your own risk.
7. Privacy
Your privacy is governed by our Privacy Policy. We use Google Firebase for backend services. Data processing is subject to Google’s Data Processing and Security Terms, which we incorporate by reference.
8. Termination
We may suspend or terminate your access at any time, with or without cause or notice, including for violation of these Terms. Upon termination, your right to use Quixyr ends immediately. You may delete your account via the “Delete My Account” feature.
9. Disclaimers & Limitation of Liability
Quixyr is provided “as is” without warranties of any kind. We do not guarantee availability, accuracy, or safety of interactions. To the fullest extent permitted by law, Quixyr LLC and its affiliates shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Services. Our total liability shall not exceed $25 USD.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in New York County, New York.
11. Changes to Terms
We may modify these Terms at any time. We will provide at least 30 days’ notice for material changes via email or in-app. Continued use after changes constitutes acceptance.
